Terms and Conditions of the “40,000.00 PLN Guaranteed Profit” Promotion

PROMOTION TERMS AND CONDITIONS
GUARANTEED PROFIT 40,000.00 PLN
valid from February 1, 2025 to May 31, 2025
Promotion Organizer
The Promotion Organizer is Darłówko Development limited liability company with its registered office in Darłowo, ul. Rybacka 16, 76-150 Darłowo, entered in the entrepreneurs’ register maintained by the District Court in Koszalin, 9th Commercial Division of the National Court Register under number KRS 0000336263, NIP 8393098080, REGON 22080169800000.
Promotion Partner
The Promotion Partner is Darłówko Rental Company limited liability company with its registered office in Darłowo, ul. Rybacka 16, 76-150 Darłowo, entered in the entrepreneurs’ register maintained by the District Court in Koszalin, 9th Commercial Division of the National Court Register under number KRS 0000733875, NIP 4990672018, REGON 38033261500000.
Promotion Participant
A natural person or legal entity who, during the validity period of the Promotion, i.e., from February 1, 2025 to May 31, 2025 enters into an apartment sale agreement with the Organizer for an apartment covered by the Promotion.
Subject of the Promotion
The subject of the Promotion is the payment of Guaranteed Profit to the Participant in case of purchase by the Participant of an apartment covered by the Promotion and after fulfilling the Promotion conditions.
Key Terms
Sales Office – the office of Darłówko Development sp. z o.o. with its registered office in Darłowo located in Darłowo (76-150) at ul. Rybacka 16;
Guaranteed Profit – the amount of 40,000.00 PLN net for the first year of the apartment lease agreement concluded with the Promotion Partner;
Owner’s Stay – the Participant’s right to use the apartment under the conditions specified in the lease agreement concluded with the Promotion Partner;
Promotion – the “40,000.00 PLN Guaranteed Profit” Promotion;
Terms and Conditions – these Terms and Conditions of the 40,000.00 PLN Guaranteed Profit Promotion;
Playroom – includes a room located on the ground floor of the residential and commercial building “VistaMar” located in Darłowo at ul. Bulwar Zachodzącego Słońca 2, equipped with equipment and devices intended for children’s recreation;
High season – means the following periods: (i) the period from June 15 to September 15 in a given year,
(ii) the Christmas and New Year period, (iii) the period between May 1 and 3 in a given year
and Saturday and Sunday immediately preceding these days and following these days, (iv)
the Easter period, (v) the long weekend period occurring on the occasion of Corpus Christi,
(vi) the November long weekend period (November 11) in a given year.
Recreation Zone – includes a room with a swimming pool, fitness room, saunas, children’s paddling pool and jacuzzi, located on the ground floor of the residential and commercial building “VistaMar” located in Darłowo at ul. Bulwar Zachodzącego Słońca 2, as well as a designated area with loungers on the patio.
Promotion Conditions
- The Promotion covers “Studio” type apartments with an area from 26 m2 to 36 m2. The number of apartments covered by the Promotion is limited and these are:
- fully furnished and equipped apartments, i.e.: V21/3, V22/3, V23/3, V24/3 located in the VistaMar building at ul. Bulwar Zachodzącego Słońca 2, 76-150 Darłowo,
- apartments requiring furnishing and equipment according to standards specified by the Promotion Partner, i.e.: V21/4, V22/4, V23/4, V24/4, V25/4 located in the VistaMar building at ul. Bulwar Zachodzącego Słońca 2, 76-150 Darłowo.
- To benefit from the Promotion, the Participant must, during the validity period of the Promotion, conclude an apartment sale agreement with the Organizer for an apartment covered by the Promotion and simultaneously conclude a lease agreement for this apartment for a period of 3 years with the Promotion Partner.
- In case of termination of the lease agreement for any reason before the expiry of 3 years, the Participant will be obligated to return in full the Guaranteed Profit paid to them as part of their use of the Promotion.
- The Organizer will pay the Guaranteed Profit after the expiry of 12 full calendar months counted from the day of concluding the sale agreement, after the Participant presents a properly issued VAT invoice or bill to the bank account indicated by the Participant in the VAT invoice or bill.
- After the expiry of 12 calendar months from the day of concluding the sale agreement, the Profit paid to the Participant will depend on the actual income achieved by the Promotion Partner from the apartment lease and will constitute 70% of the net income achieved from the apartment lease.
Additional Benefits from the Promotion
- In the first year of the lease agreement, the Participant has the right to 14 days of Owner’s Stay outside the high season, in subsequent years the Owner’s Stay can be realized without restrictions.
- During the first year of the lease agreement, the Organizer covers expenses in the form of:
- administrative fees to the housing community,
- utility bills (heating, water, electricity),
- fee for the Playroom (currently 150 PLN/month in high season and 100 PLN in the remaining period),
- fee for the Recreation Zone in the VistaMar building (currently 500 PLN monthly).
After the first 12 months period, the Promotion Participant undertakes to cover the above-mentioned costs throughout the entire duration of the lease agreement.
Method and Deadline for Using the Promotion
- You can join the Promotion by submitting a declaration of intent to use the Promotion by phone at +48 604 558 100, by email at sprzedaz@pocrealestate.pl or in person at the Sales Office.
- You can join the Promotion from February 1, 2025 to May 31, 2025 or until the apartments covered by the promotion are exhausted.
- The Organizer has the right to verify whether the Participant meets the conditions for using the Promotion specified in the Terms and Conditions.
Complaint Submitted by a Participant Who Is a Natural Person
- A Participant who is a natural person may submit a complaint:
- in written form – in person at the Sales Office or by postal mail within the meaning of art. 3 point 21 of the Act of November 23, 2012 Postal Law to the address: 76-150 Darłowo, ul. Rybacka 16 with the note “COMPLAINT”
- orally – by phone at tel. +48 604 558 100,
- in electronic form to the email address: sprzedaz@pocrealestate.pl.
- In the content of the complaint, the Participant who is a natural person should include personal data enabling their identification, e.g., name, surname, residential address, PESEL number, apartment number, as well as a description of objections regarding services provided by the Organizer.
- At the request of the Participant who is a natural person, the Organizer will confirm the submission of the complaint in the form requested by the Participant.
- The Organizer considers the complaint without undue delay, but no later than within 14 days from the day of receiving the complaint. To meet the deadline, it is sufficient to send the response before its expiry.
- The Organizer provides the Participant who is a natural person with a response to the complaint in paper form or in electronic form to the indicated email address.
- In case of failure to meet the complaint consideration deadlines by the Organizer, the complaint is considered to be resolved in accordance with the Participant’s will.
Complaint Submitted by a Participant Who Is a Legal Entity
- A Participant who is a legal entity may submit a complaint:
- in written form – in person at the Sales Office or by postal mail within the meaning of art. 3 point 21 of the Act of November 23, 2012 Postal Law to the address: 76-150 Darłowo, ul. Rybacka 16 with the note “COMPLAINT”
- orally – by phone at tel. +48 604 558 100,
- in electronic form to the email address: sprzedaz@pocrealestate.pl.
- In the content of the complaint, the client who is a legal entity should include data enabling their identification, e.g., company name, registered office address, KRS number, apartment number, as well as a description of objections regarding services provided by the Organizer.
- At the request of the Participant who is a legal entity, the Organizer will confirm the submission of the complaint in the form of an email message.
- The Organizer considers the complaint within 14 days from the day of receiving the complaint. To meet the deadline, it is sufficient to send the response before its expiry.
- In particularly complicated cases that make it impossible to consider the complaint and provide a response within the deadline referred to in point 4, the Organizer in the information provided to the Participant who submitted the complaint:
- explains the reason for the delay,
- indicates the circumstances that must be established to consider the case,
- determines the expected deadline for considering the complaint and providing a response, which cannot exceed 30 days from the day of receiving the complaint.
- The Organizer provides the Participant who is a legal entity with a response to the complaint in paper form or in electronic form to the indicated email address.
- In case of failure to meet the complaint consideration deadlines by the Organizer, the complaint is considered to be accepted.
Additional Provisions
- These Terms and Conditions are the only document that defines the detailed rules of the Promotion.
- The Terms and Conditions are available at the Sales Office.
- Upon request of the Participant, the Terms and Conditions may be sent to the indicated email address.
- The Promotion cannot be combined with other promotions organized by the Organizer.
